GENERAL REQUIREMENTS

FOD was founded by PT. Surya Multi Laksana which is located at Jalan Soekarno Hatta No. 207A Bandung, West Java, Indonesia.

Every activity related to the use of the website, both organizers, users in this case including sellers (merchants) and buyers, are legally protected through Law of the Republic of Indonesia No. 11 of 2008 concerning Information and Technology, Law of the Republic of Indonesia No. 19 of 2002 concerning Copyright, and for all forms of engagement arising from all activities on our website have met the rules and requirements for the validity of an agreement as stated in the Book of Laws Indonesian Civil Law Law.

 

1. DEFINITION

In these terms and conditions;

  • “Account” means the FOD Account that you need to register on the website if you wish to place an Order;

  • “you” means the Customer who placed the Order;

  • "Personal Data" means any data, information and or information in any form from time to time (including what you include or convey in, on or through the website including but not limited to: name, email, cellphone number, address according to identity (address, sub-district, sub-district, city/regency), postal code, occupation, correspondence address (address, kelurahan, sub-district, city/regency) and credit card information (customer's choice), and data generated or obtained from using services, websites and/or applications that we can use to identify, contact or locate you.

  • "Customer" means everyone who places an Order on our website.

  • "Order Confirmation" means your email to you, in which we acknowledge your Order in accordance with clause 5.2 below;

  • “Intellectual Property” means all copyrights, patents, utility innovations, trademarks and service marks, geographical indications, domain names, layout design rights, registered designs, design rights, database rights, trade or business names, rights to protect trade secrets. and confidential information, the right to protect goodwill and reputation, and all other similar or related proprietary rights, whether in existence or created in the future, anywhere in the world, whether registered or not, and all other benefits, privileges, rights to sue, recover damages and obtain relief or other remedies for any past, current or future breach, abuse or infringement of any of the rights mentioned above.

2. REQUIREMENTS

To place an order on the website, you must be over 18 (eighteen) years of age. If you are under 18 (eighteen) years of age, you may place an order on the website only with the consent of your parent or legal guardian.

 

3. BAN

You must not abuse this site. You will not commit or support criminal acts, transmit or distribute viruses including Trojan horses, Worms, Logic Bombs or transmit other harmful material on the website, dangerous technology, violate trust or in any way that is or is harassing, enters any aspect of the service, damages data, causing interference to other users; violating the decency of others; send unsolicited advertising or promotional materials; or try to affect the performance or function of any computer facility or access to the entire website. 4.2. Nothing in these terms and conditions will exclude or limit the liability of FOD for death or personal injury arising from negligence, submission, misinformation, and misrepresentation of underlying matters or other liability which cannot be excluded or limited by applicable Laws.

 

5. INDEMNITY

You agree to indemnify, defend, hold harmless FOD Directors, Officers, Employees, Consultants, Agents and Affiliates from any and all third party claims, liabilities, damages and or costs (including but not limited to, Legal fees) arising from the use of the site this or your breach of these terms and conditions.

 

6. GUARANTEE AND COMPLAINT MANAGEMENT

6.1. FOD will carry out its obligations based on the appropriate terms and conditions.

6.2. We place great value on the satisfaction of our customers. You can contact us at any time using the contact details provided. We will endeavor to resolve your issue as quickly as possible and will contact you for an investigation regarding the complaint.

6.3. In the case of a complaint, it will help us a lot if you can describe the object of your complaint as accurately as possible and if possible send us a copy of the order or at least the order number that we gave you in the order confirmation. In rare cases your email may get caught in our spam filters or not reach us, or correspondence we send to you may otherwise not reach you. If you do not receive a response from us within 5 (five) working days, please contact us again.

 

7. PROTECTION OF PERSONAL DATA

8. RIGHTS AND OBLIGATIONS

8.1. You are obliged to pay in full for all transactions made in accordance with the terms of the transaction and payment. If you have not made the payment within the specified time, we have the right to declare that the order has been canceled by you.

8.2. You must be fully responsible for all things done on the FOD website which is in the name of your account.

8.3. You have the right to choose the payment method that has been provided by us, according to your convenience and comfort when making transactions.

 

9. CIRCUMSTANCES BEYOND OUR CONTROL (FORCE MAJEURE)

9.1. We are not responsible to you for any violations, delays or delays in the implementation of product purchases caused by anything beyond our control, including but not limited to:

  1. Strikes, lock-outs or other industrial measures

  2. Civil commotion, riot, invasion, terrorist uniform or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

  3. Fire, explosion, storm, flood, earthquake, landslide, plague or other natural disaster.

  4. The impossibility of using trains, planes, motorized transportation or other means of transportation, whether public or private.

  5. Impossibility of use of public or private telecommunications networks.

  6. Governmental acts, decrees, laws, regulations or restrictions, shipping, postal or other transport related strikes, failures or accidents.

9.2. In the event that the Force Majeure event lasts for more than 1 (one) week, either You or We terminate the purchase or sale of the product immediately with written notification and without any obligation other than returning the product that has been paid for by You and not delivered.

9.3. If we have given our consent to provide identical or similar products to more than 1 (one) customer and are prevented from fully fulfilling our obligations to you for reasons of Force Majeure, we have an absolute decision to purchase whichever product applies.

9.4. We have absolute discretion on the solutions we take in fulfilling our obligations under the purchase of products despite Force Majeure.

 

10. NOTICE

Any notification based on the purchase of the product will be given in writing either by letter or email to the party concerned at the last known address or email address.

10.1. Notices given by post must be deemed to have been given within 2 (two) working days of being sent to the recipient's address in Indonesia.

10.2. Any notification provided by email shall be deemed given within 2 (two) working days of the email being sent. In proving the service, it must be sufficient to prove that the letter or email was actually sent and may have been sent as a prepaid letter of delivery and or delivery or delivery report received.

 

11. INTELLECTUAL PROPERTY RIGHTS

11.1. All content included in or available through our website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, campaign titles and data compilation belongs to FOD or content suppliers and is protected by copyright law, all these rights protected by FOD and the license. 11.3. You may not use any part of the content on our site for commercial purposes without obtaining a license to do so from us or our licensors. In the event that FOD becomes aware of an intellectual property infringement, We will not refrain from taking relevant legal action.

11.4. If you print, copy or download any part of our site in violation of these terms and conditions, your right to use our site will immediately terminate and you must, at our option, return or destroy any copies of the material you have made. You will not modify, translate, decompile, disassemble or create derivative works based on the software or accompanying documentation provided by FOD or its licensors.

We reserve the right to change these terms and conditions at any time. All changes to these terms and conditions will be posted online. Use of the Website and or Site will be deemed acceptance of the new terms and conditions. When you submit an order to the Website and or the Site, you agree that you do so and are subject to the terms and conditions that apply on the date you send your order. You are responsible for reviewing the most recent Terms and Conditions each time you submit your Order.
